Changes to essential travel services that become necessary after the conclusion of the contract and are not caused by the tour operator in bad faith are permitted, provided that they are not substantial and do not affect the overall nature of the trip. Such changes may include, for example, transfers to an identical ship operated by the same cruise line, changes to sailing times and/or routes on river cruises due to high or low water levels, safety or weather conditions, the cancellation or modification of sections of the itinerary, the use of other means of transport for certain sections, as well as the cancellation or modification of excursion programmes. In individual cases, hotel accommodation may be required.

The customer may cancel the trip in writing at any time before the start of the trip. The date on which the cancellation notice is received by the tour operator shall be decisive. In the event of cancellation or failure to commence the trip, the tour operator shall no longer be entitled to the agreed travel price. However, provided that the cancellation is not attributable to the tour operator, the tour operator may claim reasonable compensation for travel arrangements already made and expenses incurred. The amount of the cancellation fee depends on the respective travel price. The customer is free to provide evidence that no loss or a substantially lower loss has been incurred. In all cases, a minimum processing fee of €150 per person will be charged.

In the event of cancellation by the customer, a flat-rate compensation for travel arrangements made and expenses incurred shall be payable per person. The amount of this compensation shall be calculated based on the date on which the customer's cancellation notice is received by the tour operator:

• Cancellation received by the tour operator up to 90 days before departure: 20% of the travel price
• Cancellation received by the tour operator up to 60 days before departure: 35% of the travel price
• Cancellation received by the tour operator up to 30 days before departure: 50% of the travel price
• Cancellation received by the tour operator up to 15 days before departure: 80% of the travel price
• Cancellation received by the tour operator up to 1 day before departure: 85% of the travel price
• Cancellation on the day of departure: 90% of the travel price

As a general rule, the customer has no entitlement to rebooking after the conclusion of the contract. This applies in particular to changes to the travel date, destination, place of departure, accommodation, fellow travellers or means of transport.

However, rebooking free of charge is possible if it becomes necessary because the tour operator failed to provide any, insufficient or incorrect pre-contractual information in accordance with Art. 250 § 3 EGBGB.

If rebooking is nevertheless permitted at the customer's request, the following rules apply:

• Up to 90 days before departure: Rebooking may be made subject to a rebooking fee of €150 per customer.
• From 89 days before departure: Rebooking requests, if possible at all, can no longer be processed as a direct rebooking. In this case, the customer must first cancel the existing travel contract and subsequently make a new booking. The applicable cancellation terms will apply.
• Additional costs: Any costs incurred by service providers, e.g. airlines, as a result of the rebooking will be charged separately.
• Minor changes: Rebookings that result in only minor costs are exempt from these provisions.
• Transfer to another person: The transfer of the travel contract to a third party is subject to the statutory provisions of § 651e BGB.
• Payment due: Any applicable processing, cancellation and rebooking fees are due for payment immediately.

If the traveller does not make use of individual travel services that were properly offered to them for reasons attributable to the traveller (e.g. due to an early return journey or other compelling reasons), they are not entitled to a proportional refund of the travel price. The tour operator will endeavour to obtain a refund of any expenses saved from the respective service providers. This obligation does not apply if the services concerned are entirely insignificant or if a refund is prevented by statutory or official regulations.

The carrier assures passengers that it has great respect for people with reduced mobility who wish to travel. Accordingly, it is not the carrier’s intention to discriminate against such persons in any way. However, participation in a river cruise places particular demands on passengers’ mobility. On all ships, passengers must be able to use stairs and ramps to board and leave the ship without walking aids or a wheelchair. These are generally not wide enough to accommodate such mobility aids, and due to the limited width of the stairs and ramps, it is often not possible for other persons to provide assistance with mobility.

Scooters and wheelchairs generally cannot be accommodated on board. The carriage of other walking aids may also be restricted for safety reasons. For this reason, passengers with special needs must enquire about the possibility of participating in the cruise before completing their booking and/or obtain the carrier’s approval.

If a passenger is not permitted to travel for this or any other medical reason, this shall not give rise to any claim for compensation against the carrier, regardless of the reason.

For pregnant passengers: For safety reasons and due to the limited medical facilities available on board, expectant mothers are advised against taking a cruise from the 24th week of pregnancy onwards
